What is an ITIN, and do you actually need one?

A nine-digit number the IRS issues for tax processing only. It is not immigration status, not work authorisation, and not a Social Security Number.

The short definition

An Individual Taxpayer Identification Number is issued by the IRS to people who have a United States tax filing or reporting obligation but are not eligible for a Social Security Number. It always begins with 9 and has the same nine-digit shape as an SSN.

What it does

It lets the IRS process a return, a refund claim, or a third-party information report that carries your name. That is the whole purpose.

What it does not do

An ITIN gives you no right to work in the United States, no immigration benefit, no Social Security entitlement, and no change in your residency status. Anyone who suggests otherwise is misinforming you.

The test the IRS actually applies

You do not qualify because you want a number. You qualify because you have a federal tax purpose. In practice that means one of two things:

  • You are filing a U.S. federal tax return — and the ITIN application travels attached to it, or
  • You fall into one of the published exceptions that allow a Form W-7 without a return

If neither is true, the application will be rejected. This is the single most common reason people lose both a fee and three months.

Who typically needs one

  • Foreign owners of U.S. entities — a single-member LLC with a filing obligation, or a partner receiving a Schedule K-1
  • Nonresidents with U.S.-source income — rent, royalties, scholarships, investment income reported on Form 1042-S
  • Sellers of U.S. real property — FIRPTA withholding needs to be reconciled on a return
  • Spouses and dependents claimed on a U.S. return who have no SSN
  • Treaty benefit claimants whose payer needs a number before reducing withholding

Applying without a tax return: the exceptions

A limited set of situations allows a Form W-7 to be filed on its own. Each has its own documentary requirements, and the documents are checked strictly — a bank letter that merely confirms an account exists is not enough; it has to state that the account is subject to IRS information reporting and withholding.

  • Third-party withholding on passive income, including treaty-based reductions
  • Wages, scholarships or fellowships with treaty or reporting involvement
  • Mortgage interest reporting — the lender must report Form 1098 against a number
  • Disposition of U.S. real property under FIRPTA, often with Form 8288-B
  • Reporting obligations for certain foreign-owned entities

Worth knowing: when a Form W-7 is filed together with a FIRPTA withholding certificate application, the ITIN is often issued considerably faster than the standard timeline, because the property closing depends on it. Whether this applies to you depends on the transaction — we confirm it before you rely on it.

Expiry and renewal

An ITIN expires on 31 December of the third consecutive tax year it has not appeared on a federal return. The number itself does not change when you renew; only its status does.

Two practical consequences people discover too late:

  • Filing with an expired ITIN delays the return and can reduce or deny credits tied to it
  • On a joint return, one expired ITIN holds up the entire return, not just that spouse's part

Renewals now generally require a federal return attached, which was not the case a few years ago. If you were told otherwise, the information is out of date.
